Step 1: Check registration criteria

a. Does your trademark meet the registration criteria?

To be registered for protection, your trademark must meet the following basic requirements:

  • Don't just include descriptive signs of your goods or services (e.g. best, cheap);
  • Not only does it include signs that are common in current language or established trade practice (for example, the mark “Escalator” has become so widely accepted that it is used to describe passenger elevators and can no longer be used to distinguish traders selling such goods);
  • Not identical or confusingly similar to an existing trademark.

b. Check if similar trademarks already exist?

Before filing an application, you should perform a Similar Trademark Search on the IPOS Digital Hub to ensure that there are no trademarks on the Registry that are identical or similar to your trademark.

  • If a trademark is found to be identical or similar to your trademark and is protected for similar goods or services, your application may be refused.
  • In some cases, you can overcome this refusal by providing a letter of approval from the registered trademark owner.

c. Have you classified your brand properly?

The scope of protection of your trademark is determined by the list of goods and/or services listed in the application. You must state the exact class number and appropriate description of the goods and/or services according to the Nice Classification. According to the Nice Classification, there are 45 classes of goods and services.

Step 2: Filing Trademark Application

When ready, prepare:

  • Clear, standard image of the trademark you want to register
  • List of goods and/or services related to this trademark
  • Form TM4 must be filed to file a trademark application in Singapore. Your trademark application filed via Form TM4 must include:
    • Name and address of the applicant
    • A clear graphic image of your brand
    • List of goods and/or services for which you want to register your trademark
    • Statement of your use or intention to use the mark
    • Relevant application fees (as indicated below).

Step 3: Application Review

Once filed, the application will be examined by the Intellectual Property Office of Singapore (IPOS). This process checks whether the application meets the requirements for protection. If there are no objections or additional requirements, the application will move to the next step.

Step 4: Publish the application

If the application passes the examination stage, IPOS will publish the application in public media for a period of 2 months. During this period, third parties have the right to object if they believe that the trademark may affect their interests.

Step 5: Successful Trademark Protection

If there are no objections during the publication period, IPOS will issue you a Certificate of Trademark Registration. The trademark will be officially protected and valid for 10 years from the date of issuance.
